In Kenya, property owners and landlords are required to pay statutory charges to the government in accordance with the law. These charges are levied by various government agencies and are meant to support the provision of public services such as security, health, education, and infrastructure development.
The legal clause governing statutory charges in Kenya is the Local Government Act, which was amended in 2012. Section 107 of the Act stipulates that every property owner or occupier shall pay the prescribed rates and charges to the relevant local government authority. The Act reads:
“107. Payment of rates and charges. (1) Every owner or occupier of any rateable property within a local authority area shall be liable to pay such rates and charges as may be prescribed by the local authority by which the area is administered. (2) The liability to pay rates and charges shall attach to the property in respect of which they are payable and shall be a first charge thereon, and shall take precedence over all other charges or claims whatever, except the land rent payable to the Government by virtue of the lease of any public land.”
The Act also provides for the establishment of local government committees to oversee the collection and management of these charges.
In addition, landlords are also required to pay relevant taxes on their rental income to the Kenya Revenue Authority (KRA). Failure to pay these taxes can result in penalties and legal action.
